Employment Discrimination and Help With a Litigation Fix!

As a vocational expert, I can help sort out the consequences of employment discrimination cases in many ways and from “both sides of the fence”.  To me, this phrase meant I will be fully instrumental to help serve your client without falling off and hurting the case because I have a full grasp of what I’m on to. To accomplish this goal, I balance your case with your client’s story and use all my instincts and brain power….kinda like a cat!

Cats’ tails serve as a counterbalance when cats walk on narrow spaces, such as fences. However, one of my felines from long ago, (Max 1987 – 2002) was a Manx, henceforth no tail but he was well able to manage cat life with his strong body shape in every way! I asked my vet, and yes, even cats with amputated tails have proven to re-learn how to balance.

Employment discrimination cases need plenty of proof and evidence. Loss of salary, loss of benefits, and lengthy unemployment can be quantified pretty easily. Other issues are more difficult to assert. For example, if there is a claim the loss of job adversely impacts income and questions surface regarding economic realities, I can help with educating the individual on how to engage in a meaningful and productive job search, or I can assess the extent, quality, and reasonableness of a current job search. It is important to keep employer attitudes towards hiring an individual terminated from previous employment in mind.

Further, I can help to determine the impact on earnings potential and perform a vocational assessment and evaluation that provides data such as ~

  • the number, types, and wage level of jobs available prior to the discriminatory action
  • vocational options following the discrimination or termination
  • local job availability and wages and benefits associated with those jobs

I can also help uncover whether or not a good cause for termination of employment existed. That’s why documenting real time employer comments become helpful to sort out the nuances of the case. I’ll take a deep look at a behavior or situation that any reasonable person agrees would warrant discharge. I can help determine the ramifications of ~

  • Work performance and productivity
  • Attendance
  • Violation of work policies and rules
  • Dishonesty
  • Endangerment of health and safety*
  • Illegal conduct
  • Insubordination
  • Personality/attitude problems
  • Poor interaction with subordinates.

*If disability is involved in the case, under the employment provisions of the Americans with Disabilities Act (Title I of the ADA), I can assess for reasonableness and identify reasonable accommodations. Keep in mind I believe that for every disability there is some form of assistive technology to allow continued employment.

In one case I’m aware of, the divorcing woman declined to hire her own expert (umm: me) and found herself at a serious disadvantage. The “opposing” vocational expert sure did a number on what he declared she would earn in today’s workforce even though she hadn’t worked anywhere in 10 years!

There were inaccuracies and factual errors in this expert’s report on a specific career (it was teacher) that made me wonder if he (the opposing expert) had actually ever talked to a teacher about their job in real life! (Ahh, try being married to a teacher like me!) The opposing expert did not make sense! You simply don’t start out (with an outdated bachelor degree, no license, no certification(s), and no recent teaching experience) at $50k!! Not reality!

Lifting at Work……and the Power of an Ant! Need a Job Analysis?

In the past I’ve blogged about when my father managed a Culligan Soft Water branch. I remember watching the workers (like Gary and Big John!) move the 150# water softener tanks from the regeneration area onto the big trucks for the next step which is to drive to their customers’ locations.

Growing up, we (mostly my brother Steven & I) played games on the shop dollies!

I remember watching the workers unload the tanks and bags of salt off the truck, maneuver the tanks onto a dolly, then push or pull the load to the customer’s house. They then donned a heavy strap across their bodies, and carried the tanks down a flight of steps into a basement. I was enthralled with that process!

These work tasks took strength and intelligence in how to best carry and maneuver a large and heavy object. The worker would then take the tanks that needed to go to the shop for regeneration back up the steps. Then the bags of salt would follow, into the home, and be emptied in to the tanks. Then on to the next stop for the route drivers. And they would repeat the process throughout the day.

Nowadays the tanks and the bags of salt are about ½ the weight, which leads me to my topic for this blog – lifting….at work.

I’m not very big, nor very tall, and I really don’t know how much I can lift safely because all lifts involve time, place, setting and purpose! Yes, being a petite person ~ I’m 5’2″ with small wrists, I’ve learned many different ways to get want I want or need without heed to any physical challenge. I also exercise regularly and if I realize the object to lift is too heavy, I either get help or get smart!

I can improvise to get something off a high shelf (use a yard stick). I can figure out how to move something that weighs twice my weight (eg: a filled bookcase) with the use of furniture sliders). I can break any heavy item apart to make it lighter! Any person can lift objects and loads that are heavy…..using mostly brain power and not any brawn power!

Brain over Brawn!

I’ve been trained how to perform a job analysis prior to preparing a job description. I have reviewed and critiqued many a job description. Here are my educated thoughts about a job description that lists the physical demands [of a job] requiring a worker to lift up to 50 pounds (or any other weight).

When I am helping a job seeker who has a lifting limitation, say of 25 pounds, there are considerations to assess prior to including a job(s) that may call for lifting more than, say 25 pounds.

Did you know ants can lift 20 times their own body weight?

The following considerations are taken into account when assessing whether or not a person can safely lift at work (or anywhere for that matter!):

  • Size and strength of the worker
  • Load – what actually needs to be lifted? and why?
  • The weight of object handled
  • The muscle force applied by the worker to do physical lifting
  • Posture – the postures adopted to lift the object
  • Environment – the workplace, the conditions, for example, slippery floors, walking up steps, restricted space to work in, lighting and the ability to get a good grip on the object.
  • Time – the amount of time that is spent doing the lifting – or the number of repetitions of an action each day.
  • Research and identify what accommodations are in place or could be in place to allow the job to be performed efficiently and safely
  • Workplace layout – the amount of moving of the objects required
  • Equipment – what is available, or could be used, to help move the load?

It’s very important to always take time to specifically address what needs to be moved, where it is to be moved, and why……and then be smart about the lifting process. Think about how any heavy or ackward lifting can be accomplished in a smarter manner.

The Skills of a Football Player…and a Fantasy!

[Original Post Date: Oct 8, 2012] Randy and I got back from Kansas City last night, after spending the weekend in Missouri. Once again, in comparison to the people we encountered in Chicago a few weeks ago, I found locals clad in red to be quite friendly!

We went to yesterday’s Chiefs game.  It was fun to go, but alas they did not win.  And yet, believe it or not, the incredible fans around us were well behaved!

Chiefs! We try to go once a year….a goal!

Have you ever considered the skills of a football player? I have!  And they’re quite similar to what most employers look for in a good employee.  Here’s a sample of five…

1.  Meeting the challenge

…read on for more transferable skills of a NFL player…. The skills are not much different from what employers desire!

I’ve always wanted to help out a professional, or a semi-professional athlete find work upon retirement, or following an injury. Someday!   I’ve also always wanted to (one of my many fantasies), kick one right through the uprights!

It’s Good!

As far as football injuries, I did a little research:  The Top 5 (with the research saying that most injuries occur during competition and not during practice):

1. Hamstring Strain

2. Sprained Ankle

3. Knee Cartilage Tear

4. Hernia

5. Anterior  Cruciate Ligament (ACL)*

*  [Update to this…..oh, NO Jamaal Charles, what are the Chiefs going to do without you???? On Sunday’s 10-11-15 game against the Bears …… who won 18-17 : ), he sustained this type of injury (right knee) and is out for the rest of the season. I love watching him play! for ] Charles missed all but two games of the 2011 season because of a torn ACL in his left knee.

We’ve all had, correction, I know I have had #2 more than once. Randy has had #4 more than once. We’ve all heard of a football player tearing #5. Thankfully, we don’t see back injury or brain injury on this list although I’m sure they happen.  Here’s a link to NFL players currently on the injury list….and on the mend … makes ya think.

Oh, and how much $ does the average professional football player make? About $1.1 million. Source: Randy Botkin ha ha! Now of course that means some make $10 million+++ and some make $100,000. Is it worth it? Makes ya think again. Especially if your career lasts oh about 3 years and your life can be shorted maybe what 20-30 years? Source: Randy Botkin again!

BTW, you may recall Peyton as the quarterback for the Denver Broncos missed the entire 2011 season due to a neck injury requiring him to have neck surgery twice. Rehabilitation counseling was incredibly important to him, I’m sure.

I often work with clients (ones who experienced an injury while at work) with some type of back injury and are no longer able to do the work they did previously.

Have you ever thought about what you do now for a living and if something were to change, what you could do in the future to make money?  Something I help people to think about all the time….makes you think once last time I hope.

I Agree Whatever Makes You Happy You Put in Your Own World! Chocolate Long John!

As I wrote about last week, Randy received the 2015 Alternative Educator of the Year! At the April 21, 2015 Des Moines Public School District Board Meeting he gets recognized. Randy endured quite a bit of silliness and a lot of congratulations from his co-workers at Scavo High School about this “award” but all in all, be proud Mr. Botkin! Here’s the letter announcing the news: Scavo Teacher Named Alternative Educator of the Year.

I’ve written about this before…..because it’s exciting! Randy will be engaging much more when school begins again this Fall 2015 (I know I know, school is almost out for this school year, why talk about restarting it already) as Scavo’s work experience coordinator!

This will be great for him…..after 22 years in a classroom (not that he’s ditching a classroom nor teaching, this is more of a melding of his skills to help his students). Randy has taught many different subjects, ranging from baking (I remember those yummy strawberry pies), to parenting (he’s a natural!) to history (his cup of tea), and algebra too (ahh, no comment)!  I remember one year he taught wood shop. We still have a bench he made which is ironic because he’s not very good at cutting a straight line! Sorry guy! Just the truth!

Mr. Botkin’s primary endorsement is in behavioral disorders making him basically a major troubleshooter!  Can a person’s behaviors change? Of course! I’ve learned the key to maintaining  new behaviors…is to be happy! Want some cookies with that cup of tea? I just remembered something……    🙂

Randy and his students used to take orders twice a month (this was several years ago) for 10 dozen school-baked cookies for the Des Moines School Board meetings. Two dozen a piece he reminds me: of chocolate chip, oatmeal raisin, sugar, peanut butter and ? oops I forgot! Maybe macaroons? Are macaroons too difficult to teach teens how to bake? I’ve never made them.

During those days Randy (and all his fellow BD educators and staff members) taught here, at the original Casady building on 16th!

The Casady Building, built in 1905, was demolished a month or so after I took this shot June 12, 2013! 

Another new source of happiness for our daughter Arin lies in her employment. She is now working at Zombie Burger as a host. (She continues at the Des Moines Library, too!) AJ has wanted to work at this popular restaurant (there was a 2 hour wait this Saturday, even in the rain) for a long time! After putting her two weeks’ notice from Walgreen’s in, she started a couple of weeks ago. I am so proud of my daughter’s work ethic! Ah heck, everyone in my families! Arin has said to me about both her jobs “I Really Love What I Do….!” Why Do You Do Your Work? You too may be in love!

A little update on the Botkin boys. Last year, Nick received a promotion at Well’s Fargo. He is doing so well that recently he received an award as well! This award includes a full-ride trip to Miami (he leaves with Derek this Thursday)! Randy got $50 worth of donuts from Highland Park Bakery to share with his fellow educators at work….and he didn’t even bring me home a chocolate long john.

Jake continues at Jimmy John’s. He’s been there quite a while now (update: as of 9/2016 he still is). I think it is interesting that one of this establishment’s HR policies is that workers have to cover their tatoos (update as of 5/2016 the company changed their policy!). Yes, long sleeves in the hot summer to deliver food to people who just might be showing their tattoos. I think it is ridiculous! Don’t get me wrong, I don’t have any tatoos yet? ; )  but all three of our kids sure do (update: my mother got a tatoo for her 80th birthday!). It’s body art alright! Jake actually designs them! As I’ve written about, he is very talented at drawing!

Creative Cover Letters Entice Your Reader

I decided from my last blog (so many choices!) to write about me looking for temporary work….

Last year, I applied for a temporary part-time academic counselor position at DMACC. The position was focused on young “at-risk” students. I share my cover letter (which wanted the applicant to address certain characteristics or skills in the cover letter). I added side comments and graphics to illustrate!:

I am hopeful my master’s degree in rehabilitation counseling will be put to good use at DMACC as the college’s newest part-time temporary career counselor. I am a DMACC graduate and if it weren’t for my experiences with many of the college’s instructors (for special reasons I recall Robin Orr; and many other great teachers!), and the time in class I spent learning on the Ankeny and Urban campus, I would have never gone on to get a bachelors, let alone a master’s degree!

As a person with a colorful educational background, including being labeled a “high school dropout” I fully acknowledge the importance of a great community college. I value DMACC highly. This is where I found how much I love to learn, and better yet, I found out I wasn’t so dumb after all!

Happiness is Finding Out

 “Happiness is finding out you’re not so dumb after all.”

I love to help others, and people absorb information if it is presented in a number of different ways, in one sitting, or through several meetings and follow-through activities. My experience also tells me that as the “teacher” such knowledge has to be facilitated in a holistic manner, encompassing what the learner has offered about their background.

I’ve delivered presentations to many audiences, including youth at church, high school age learners, adults (colleagues, clients or potential customers), health-educational programs (smoking cessation, CPR/First Aid), including an entire room full of attorneys (for their continuing legal education needs). I see presentations as a way for me to become a better counselor. I re-learn the topic for the presentation, gather updated information, and focus on how to present in a creative way that makes sense for my audience.

The timing for your needs and the interest in this opportunity is coming at a great time for me. As this counselor position is temporary and part-time, it works well with my current work load as a self-employed person. I hope you read the answers to the supplemental questions I prepared for more information on the required and desirable qualifications you seek.

DiversityI believe diversity surrounds us, and without embracing this limitless concept we’d all be boring! I’ve Served as a Guinea Pig. Wheek! Wheek!

More on volunteering. As you will see, I have on my resume that I have experience as a guinea pig! Yes indeed, to help counseling practicum students (BTW: I’m currently available to help). I received free counseling sessions (!) while the student practiced. The sessions were videotaped and then viewed with the professor for a grade!

 This is Einstein. I preferred to call her Peggy!

Our beloved guinea pig died earlier in the spring 2013. She was a very nice pig. I miss her wheeks! A wheek is the loud excited noise guinea pigs make when they are excited! Wheek, Wheek! Peggy is also the name of the woman who gave us our new pet! Peggy the human (an Iowa State professor) and I connected via Craigs List. She was listing free guinea pigs but the babies were all taken, so Arin and I got the momma!

Arin (my daughter, whose shirt you see) named the pig Einstein, can you guess why? But, again I preferred to call her Peggy. She lived for several years after her arrival to our home. She really was a great pet. Back to the post Amy:

Employability, Hireability and Placeability ~ Got Ability? Need Proof?

To continue on with my post on getting level during divorce, I’m offering working definitions of 3 of my favorite ability descriptors which are Employability, Hireability and Placeability.

Although my vocational assessment and evaluation assignments span a variety of jurisdictions and are designed to meet referral needs, the concepts of Employability, Hireability and Placeability remain constructively intact.

~ Employability ~ Can try to prove

Simply put, employability refers to the capacity for a person to function in a job and to be able to move between jobs the person could actually do considering personal circumstances. There may be an overlay of disability, physical or mental limitations, or specific work-life needs that come into play when determining a person’s employability.

Employability depends on the knowledge, skills and abilities and how these assets are used within the context which work is performed or is sought. To evaluate employability, it helps to break the concept into manageable pieces. I take a look at the skills, attitudes and behaviors the person has developed through their work background and a variety of other life experiences.

To know if those skills, attitudes and behaviors are in demand, I then research and survey the person’s labor market to identify jobs that match the person’s background and capacities.

It works best for me to highlight the person’s skills and capacities in the best possible light! Skills are transferable regardless of disability, especially with creative adaptation and accommodation.

In addition, if there are avenues to match the person more closely with jobs (eg: short term training), further vocational research is performed with the results offered in a helpful way.

~ Hireability ~ Cannot prove

Hireability

The term hireability is a way of describing the likelihood an individual might get hired for a job they are physically and psychologically capable of performing.

The most prevalent method of hiring is the interview, therefore, it is always helpful to view how a person presents their skills in various environments.

Further, hireability is about a person’s soft skills, including their style of communication, level of self-confidence, initiative, tact, and motivation. All these elements are important to a business who has hiring needs!

Throughout my placement experiences, I find businesses look to hire individuals who are responsible, trainable, friendly and able to work on teams. Reliable transportation, good references, a neat appearance, and a pleasant personality are commonly preferred.

Throughout my placement experiences, I also understand often is not necessary to assess an individual for hireability, and to rely on the person’s natural ability to succeed without the need to administer a “test”.

~ Placeability ~ Can try to prove

Placeability is the likelihood that a person will actually access, secure and maintain work within his or her labor market, usually in a specific job or occupation. Placeability is affected by labor market conditions (outside of an individual’s control) and is partly about how in-demand the individual’s transferable skills are and how well she or he can present those skills.

The dynamics of placeability include the availability of jobs in a certain geographic area; employer attitudes and policies, the evaluee’s age and culture; and specific occupational hiring requirements. I’ve had many years of work experience placing people and there are numerous variables!

If the person has barriers to employment, for example a functional limitation that would benefit from accommodation, resources are discussed to avoid unnecessary conflicts in the person’s working world. Please realize all functional limitations are restrictions but NOT all restrictions are functional limitations!

Here’s another rather important variable:

Happy Labor Day…Raise the Wage!

Today on The White House Blog there is a great post which is a copy of a message sent today by Labor Secretary Tom Perez and features his friend Ms.  Austraberta Rodriguez.

Mr. Perez writes “So today, if you’re ready for a country that does right by Austraberta and the nearly 28 million Americans who stand to benefit from a $10.10 minimum wage, then honor them by adding your name here

I sure did!

I just added my name to support raising the minimum wage. It was last raised to the existing $7.25 an hour on July 24, 2009 (our Iowa minimum wage rate that is, which is the same as the Federal minimum wage.) The time has come. I choked the other day seeing a loaf of bread for over $5! How much is that cheese? That much for butter!!  No way!!!!  Then all the other high food prices starting yelling at me. I had to run out of the grocery store!

Workers Need to Make More Bread!

How can people work and make ends meet at. It is hard to believe. My daughter questions why pay is low. She wants to move on in her life, but struggles with how she can do so. Plus recently her car died. Arin continues to work at Walgreen’s however she is in interviewing mode for another job that will pay more. (She may still continue to work at Walgreen’s.)

Books that Shaped Work in America

I read the summary of a book titled The Receptionist: An Education at The New Yorker written by Janet Groth and published in 2013. I am interested in reading this book as it brings back many, many memories of my days as a receptionist (teaching me incredibly valuable work skills.) I was paid temporary worker wage way back them, which commonly was more than the minimum. Which I would say 25-30 years ago I probably received like $5-6.
